Adelaida Anderson operated a standup forklift at a FedEx warehouse in Effingham, Ill. While pulling a load in July 2017, she hit a bump and fell out of the forklift onto the floor. The forklift continued moving and ran over her leg and seriously injured her; eventually her leg had to be amputated.

Anderson brought a diversity suit against the forklift’s manufacturer, The Raymond Corp., alleging that the forklift was negligently designed. The jury trial ended in a verdict in favor of defendant Raymond.

Anderson appealed to the U.S. Court of Appeals for the Southern District of Illinois.

Anthony Bearden was walking along the shoulder of a residential road when Lloyd Young approached in a Jeep Grand Cherokee and struck him. Bearden suffered orthopedic surgeries and a traumatic brain injury. He now requires the use of a wheelchair and suffers from pain and mental distress.

Bearden sued Young, alleging negligence and wantonness. Bearden also maintained that the defendant had been speeding and driving while distracted.

After the jury trial, the jury signed a verdict for $25 million in compensatory damages.

Keith Zabielski, 51, was working for a subcontractor on a retaining wall project at a private home. Martin Russell, owner of the general contractor Just Right Construction, was operating a backhoe to transport a 1,000-pound concrete block.

As the block moved, it slid out of its supportive strap and hit Zabielski’s right knee.

Zabielski required arthroscopic surgery and physical therapy. He is expected to require a total knee replacement procedure. Currently he has difficulty walking and experiences pain and mobility issues with his left knee and back.

Alice McKee, 62, worked as a pharmaceutical delivery person. She went to the Wesley Manor Nursing Home campus to make a midnight delivery of medicine. She was unable to enter the building. After she called the nurse’s station and did not receive an answer, McKee walked over the building’s side lawn, attempting to reach a window within sight of the nurse’s station.

McKee climbed over some landscaping and unknowingly stepped into a window well, falling six feet into a cement pit.

She suffered a fractured femur, which has left her with a limp. She is unable to stand or sit for any length of time.

Dominic Consolazio suffered from a seizure disorder that was unresponsive to medicine at times. He was employed by Southern California Gas Co. in a position that required him to drive a company truck.

One morning, he was driving on a Los Angeles County street en route to a job site when he suffered a seizure. He lost consciousness and rear-ended a motorcyclist, Jason Lo, 32, who was stopped at a red light. Lo’s motorcycle became lodged under Consolazio’s truck, which continued traveling another 436 feet. Consolazio attempted to leave the scene.

Lo suffered massive blood loss, a degloving injury to his right leg, and a torn femoral artery.
